Payment Terms

1. Payment is paid through Early Bird offer at the date stated.
2. Payment is paid before the commencement of the programme. This is one full payment or planned payment confirmed before the commencement of the programme.
3. Non-refundable payment once committed to the programme.

 

VIP EXPERIENCE DAY

1. Full payment is paid before the commencement of the VIP Experience Day
2. Changing dates is subject to costs paid in advance at the venue by Gillmathias.com. The company will try to accommodate changes

EVENT BOOKINGS

A non- refundable deposit is taken at the time of booking. Full payment should be received 21 days before arrival, or shortly after booking if booking within 21 days. ALL retreats must be paid for before arrival.

 

Cancellation & Changes

Deposits of 50% of total booking value required to confirm reservations.

To protect us and to ensure you follow through on your commitment to attend the retreat you are unable to change or cancel your programme within 21 days of your start date.

You can cancel your programme up to 21 days before the start date and receive a refund – minus the deposit.

 

Between 21 and 28 days of your start date you can cancel your booking but you will forfeit 50% of the total programme value.

In using this website and entering into training or coaching with Gill Mathias, you are deemed to have read and agreed to the following terms and conditions.

 

1. Privacy Statement

 

We are committed to protecting your privacy. We constantly review our systems and data to ensure the best possible service to our customers.

 

2. Confidentiality

 

We are registered under the Data Protection Act 1998 and as such, any information concerning the Client and their respective Client Records may be passed to a third parties. However, records are regarded as confidential and therefore will not be divulged to any third party other than Gill Mathias.com

 

We will not share or rent your personal information to any third party or use your e-mail address for unsolicited mail.

 

3. Cookies

 

Like most interactive web sites this Company’s website (or ISP) uses cookies to enable the user to retrieve details for each visit.

 

4. Definitions

 

These are the terms and conditions governing the provision of training services by Gill Mathias or its subcontractors with the exclusion of any other oral or written statement or agreement whatever its legal character

 

• ‘Client or Customer’ means a company or individual that completes a course booking, purchase from the internet or any form of coaching or training or enters into a contractual arrangement.
• ‘Delegate’ means the party or parties named as attendees on the course booking form.
• ‘Invoice’ means an invoice for the charges delivered by Gill Mathias to the customer.

 

5. General

 

These Terms and Conditions shall apply to all training, purchases from the internet or coaching carried out in the provision of services by Gill Mathias to the Customer in accordance with any order confirmation authorised by the Customer. No additions to, or modifications of, these Terms and Conditions shall have effect unless expressly agreed in writing by both parties and expressed to be amendments to these Terms and Conditions.  Gill Mathias employees or agents are not authorised to make any representations whatsoever concerning the provision of services unless confirmed by Gill Mathias in writing. The Customer acknowledges that it does not rely on, and waives any breach of, any such representations that are not so confirmed.

 

6. Acceptance of Training Courses by Gillmathias.com

 

• Bookings on courses organised by Gillmathias.com can be accepted at any time up to the course start date, subject to availability.
• An official confirmation must be received from the Customer in order to reserve a place, that is payment in full. Prior to your confirmation, your place is only held provisionally. Coaching or training will be an up- front fee of 100% before the start of the course.
• Confirmed bookings for coaching, training or internet purchases can be made

 

7. Substitutions, Rescheduling and Cancellations

 

• Delegate substitutions may be made prior to the start of the course without penalty, providing Gill Mathias is informed in writing. It is the Customer’s responsibility, having referred to Gill Mathias.to confirm if the course information, is suitable for the delegate’s requirements.
• Bookings for training or coaching in any capacity rescheduled by the customer within one to seven days of the commencement date of the training course, coaching session or 6 month programme will incur a 100% fee.
• Bookings transferred by the customer more than seven days before and less than 31 days before the commencement date of the course will incur a 25% transfer fee plus any price difference in the new course fee, all transfers must take place within 3 months of the commencement date of the original class.
• Transfer requests received once a course has commenced are not acceptable and will be considered to be a cancellation and will be subject the terms and conditions regarding cancellations.
• In the event that a customer cancels a booking for which a transfer has taken place, this will incur a minimum 60% cancellation fee subject to the terms below.
• In all circumstances Gill Mathias requires written notification of any transfers.
• Cancellations by customers made more than thirty days before course, training or coaching commencement will not incur cancellation charges.
• Cancellations within one to seven days of course, training or coaching commencement will incur a 100% cancellation fee, between eight and thirty days will incur a 50% cancellation fee.
• In all circumstances Gill Mathias requires written notification of any cancellations.
• Gill Mathias undertakes to provide the training course, coaching or other services on the date specified except when external circumstances prevent this. In these circumstances Gill Mathias will endeavour to re run the course or re-arrange any training or coaching on a mutually agreeable basis.
• Gill Mathias reserves the right to cancel a course, training session or coaching though we make every effort to ensure this does not occur. In the event of a course, training or coaching being cancelled by Gill Mathias, alternative dates will be proposed or a full refund of monies paid will be made to the customer.
• Gill Mathias takes no responsibility for loss of profit and/or for any incidental, consequential special or indirect losses as a consequence of exceptional cancellations.

 

8. Sub-contracting

 

Gill Mathias reserves the right to assign or sub- contract its training courses, coaching, telephone or zoom sessions to other appointed and approved personnel.

 

9. Pricing and Payment terms for contracts to Organisations

 

• All course fees, training are either published or arranged with the client and clarified with an email. The fees are fixed, however Gill Mathias reserves the right to review and change prices should the original brief be changed.
• The training courses fee includes tuition literature and computer discussion if and when necessary.

The training course plus individual or group sessions require 50% payable in advance of the first month fees. The balance is due 14 days after submission of invoices.

Subsequent monthly invoices are payable 14 days after presentation and receipt of the invoice through email.

 

10. Individual clients

 

The full 6 month or individual programmes are payable in advance and as explained to the client is a committed, continuous and intensive course without interruption.

• Payment of the training course fee organised by Gillmathias.com should be received by Gill Mathias 30 days prior to the training course start date or on booking, whichever is the later. This arrangement can sometimes be discussed as appropriate.

2 month’s paid ’notice is required for any change or cancellation with the 6 month     programme but can be discussed with Gill Mathias.

• No training course services will be provided unless 100% payment has been paid electronically in advance (or discussed with the client.) .

 All coaching individual sessions are paid 100% in advance electronically.

• The client agrees to pay for any loss or extra cost incurred by Gill Mathias through the client’s instructions or through failure in taking delivery on the part of the client, its servants or employees.

 

11. Course and Article content for sale

 

Gill Mathias constantly strives to improve the content of its courses, strategies for training and coaching and therefore reserves the right to modify the specification of a course without notice to the Customer. A course title, duration, cost, content and location are liable to change at any time.

 

Copyright and other relevant intellectual rights exist in all text relating to the Company’s services and the full content or this website and can not be copied.

 

12. Delegate Suitability

 

• It is the Customer’s responsibility to ensure that the course, training, coaching or internet purchase is suitable for the client or purchaser’s requirements. .
• Gill Mathias urges clients to support this policy, which is designed to protect the Customer’s investment.

 

13. Force Majeure

 

Gill Mathias shall be entitled to delay or cancel delivery or to reduce the amount delivered if it is prevented from, hindered in or delayed in the provision of services through any circumstances beyond its reasonable control including but not limited to strikes, lock outs, accidents, war, fire, acts of God, reduction in or unavailability of power, break down of plant or machinery or shortage or unavailability of raw materials from normal sources of supply.

 

14. Limitation of Liability and Indemnities

 

• Except as may otherwise be expressly provided in these Terms and Conditions, all warranties, conditions, terms, undertakings and representations of any kind whatsoever, express or implied, whether by statute, common law or otherwise, are hereby excluded by Gill Mathias to the fullest extent permitted by law and Gill Mathias shall have no other obligation, duty or liability whatsoever in contract, tort, statute or otherwise to the Customer.
• Gill Mathias represents and warrants that the services provided will be performed in a professional and skilful manner consistent with the professional standards and the general customs and practices of the industry.
• Gill Mathias’s maximum aggregate liability for any and all losses, claims, demands, damages, costs and/or expenses of any kind whatsoever arising out of or in connection with any order confirmation and/or these Terms and Conditions (whether in contract, tort, by statute or otherwise) shall not, in total, exceed the amount actually paid by the Customer to Gill Mathias for the services which are the subject of the order confirmation in question.
• Without prejudice to the generality of the foregoing, Gill Mathias shall not be liable to the Customer (whether in contract, tort, by statute or otherwise) for loss of profits and/or for any incidental, consequential, special or indirect loss or damage arising out of or in connection with any order confirmation and/or these Terms and Conditions, including but not limited to: (a) loss of use; (b) loss of goodwill; (c) loss and/or corruption of data; (d) loss of information; (e) loss of business; (f) loss of goods; (g) loss of anticipated savings; (h) loss of revenue; (i) downtime; (j) any damage relating to the procurement by the Customer of any substitute services.
• For the avoidance of doubt, neither the types of loss and/or damage specified in sub-clauses (a) through (j) inclusive above nor any similar types of loss and/or damage shall constitute direct loss for the purposes of these Terms and Conditions and/or any order confirmation.
• For the avoidance of doubt, nothing in these Terms and Conditions and/or any order confirmation shall restrict and/or exclude in any way Gill Mathias’s liability for (a) death or personal injury resulting from the negligence of Gill Mathias, its officers and/or employees; and/or (b) fraudulent misrepresentation. The Customer is liable for any loss, damage or injury to Gill Mathias’s staff or their property which may arise whilst working at the Customer location or through the internet, for example, Skype or telephone and is due to negligence or breach of statutory duty by the Customer.

. Gill Mathias accepts no liability for the failure of any third party hardware, software and/or systems which may be the subject of any of Gill Mathias’s services: this includes failure to meet its operating specification.

. No part of the training material may be reproduced, stored in a retrieval system, or transmitted in any form, or by any means, electronic, mechanical, photocopying, or otherwise, without prior permission in writing of Gill Mathias or the copyright owner.

. All Intellectual Property Rights for any product or service remain the property of Gill Mathias unless otherwise stated or agreed.

While every precaution has been taken in the preparation of the training courses and associated literature, neither the author nor Gill Mathias Associates shall have any liability to any person or entity with respect to any loss or damage caused or alleged to be caused directly or indirectly by the instructions contained in the coursework or by the computer software and hardware products described in it.

 

These terms and conditions form part of the Agreement between the Client and ourselves. The assessing of this website and/or undertaking of a booking or Agreement indicates your understanding and agreement to and acceptance of the Disclaimer Notice and the full terms and conditions herein. Your statutory Consumer Rights are unaffected.
